Conditions of the RH ONLINE Loyalty Programme
1. Introduction
The purpose of this document is to set out the BASIC GENERAL AFFILIATION CONDITIONS of the R�H Online Programme, which offers its customers the opportunity to obtain discounts on products and/or services of R�H HOTELS, which are itemised below.
Obtaining and using the R•H Online Card implies the full, unreserved acceptance, of all the following General Terms and/or Conditions. By signing this document, the Holder declares his/her full understanding of the terms/conditions and shall be bound thereto until the cancellation of the Card.
Notwithstanding the above, RH HOTELS reserves the right to make changes to these General Conditions, which will be duly communicated by updates on the website www.hotelesrh.com.
2. Participation in the RH Hotels Online Card
2.1. Requesting the RH Online Card and registering in the Programme
The RH Online Card is the property of RH HOTELS, with registered address in Calle la Pipa, Edificio Cenit, 1, Local 3, 03500 Benidorm and with Spanish Tax Code No. B-03141595.
The RH Online Card is personal and non-transferable and will identify the holder by their details and membership number, enabling the holder to participate in the Programme after registration and acceptance of these General Conditions.
2.2. Discounts
The RH Card entitles you to special, exclusive discounts when making bookings at our hotels and to obtain discounts on purchases at the Bars and Caf�s. The currently available discounts are published on each hotel’s information page.
3. RH Online Cardholders
Only private individuals, over 18 years of age, who have accepted the Programme conditions may be Cardholders.
4. RH Online Card Website
Once a user has duly registered as an RH Online cardholder in accordance with the procedures set out for this purpose, they may access the Programme’s private pages by correctly identifying themselves with their access data: RH card number or e-mail address provided when registering with the programme, and the password created on activating their online account (required).
By accessing the Programme’s private pages, Holders may consult their account status, amend personal details, among other options...
RH Hotels will not be held liable for any fraudulent activities carried out by a third party who may have obtained the Cardholder’s details from the Programme’s private page, nor for the fraudulent use that the Cardholder may make of the data provided.
5. The RH Online Card
The RH Hotels Online Card is the property of RH Hotels, which reserves the right to cancel it in the event of its inappropriate use by the Cardholder. The sale or transfer of the Card is prohibited.
In the event the Card is lost or damaged, the Cardholder may request a duplicate card through the “Customer Services” section on the RH Hotels website or by phoning RH Hotels Information and Bookings: 902 995 072.
In the event the RH Online Card is stolen, the Cardholder undertakes to inform RH Hotels through the “Customer services” section on www.hotelesrh.com or by phoning RH Hotels Information and Bookings on 902 995 072. Once informed of the incident, RH Hotels will proceed with the immediate cancellation of the Card and a new one will be issued to the Cardholder as soon as possible. RH Hotels is not held responsible for the fraudulent use of the card and its benefits by third-parties.
6. Cancellation of an Account
The Account may be cancelled for any of the following reasons:
a) Upon request of the Cardholder:
Upon request through the www.hotelesrh.com website, on the customer services section, indicating full name and membership no.
b) Upon request of RH Hotels:
In each of the above cases, except the latter, the Cardholder will automatically lose their rights of use of the Card and the advantages associated with it, as well as all the POINTS accumulated on its account.
In the event of cancellation by RH HOTELS for business strategy reasons, the Cardholders will be given a term of 6 months to continue enjoying the advantages of the Programme before the Card is definitively cancelled, with the subsequent loss of the associated benefits and advantages.
In each and every case set out under the previous heading b), the Cardholder expressly renounces any claim to RH HOTELS for damages that could be caused by the cancellation for said causes.
- For payment irregularity or inappropriate behaviour in the hotel, without prejudice to any claim for damages which RH Hotels could present, if relevant.
- In the event of force majeure, or legal, governmental or other impositions of any nature that make the cancelation of the Programme necessary.
- When the business strategy of RH HOTELS so requires.
7. Confidentiality and Data Protection
Pursuant to the provisions of Statutory Law 15/1999 of 13 December on Personal Data Protection, you are hereby informed that the Personal Data which you have supplied to us and which you may supply to us in future shall be saved in a file for which Resthotel S.L. shall be responsible. You are entitled to exercise your right to access, rectify, cancel and oppose the handling of your data at our registered address (Calle de la Pipa n� 1, Edificio Cenit Local 3, 03500 Benidorm, or by writing to central@hotelesrh.com. Your personal data shall be handled in order to develop, comply with and control our business relationship, and to inform you via ordinary mail, or by electronic means, of all the products and services marketed by RH Hotels, and, in the event, any company in our Group operating in the accommodation and catering sectors, authorising, to this effect, the communication of your data to these companies. The Owner guarantees in all cases that the data supplied are correct and genuine, the owners therefore being required to keep the information up to date and in accordance with the current situation. In this sense, RH Hotels must be informed of any change to the name, address, email, etc by the Owner or Co-owner, in writing (by post, fax, email or internet), to be able to guarantee a correct service; otherwise it accepts no liability.
In order to provide a more efficient service, RH Hotels may provide the Owner with confidential information regarding the “status of his/her account” and other personal data.
As regards cancellation of the data, the contractual relationship between the Owner and RH Hotels will be understood to have terminated provided there are no outstanding claims or any situation governed by any specific law requiring it be conserved, 12 months after the Card is cancelled, all this pursuant to Statutory Law 15/1999 of 13 December.
8. Liability
RH Hotels accepts no liability:
- for any indirect or consequent damage caused to the Cardholder deriving from the use of the Card or from any of its advantages or services provided in accordance with the provisions of this Contract.
- of the damages resulting from misuse of the Card by the Cardholder in accordance with the provision of these General Terms.
- of the availability or continuity of the telematic services offered to the Cardholder, which excludes any responsibility for damages of any nature that could be occasioned by lack of availability, or continuity of its website or its services, although it will attempt to facilitate, to the best of its abilities, technical support for the person affected.
- RH Hotels is not obliged to control, nor will previously control, the absence of any virus or content element that could produce alterations to the software or hardware of the users or persons visiting the Internet web pages, or any subsequent claim for damages derived from them.
9. Jurisdiction
The Basic and Operative Conditions together comprise a single unit and shall be interpreted and applied pursuant to Spanish Law. With regard to any questions arising from the interpretation and application of these General Conditions, the parties expressly renounce any codes of law that may correspond to them and expressly undertake to be bound by the jurisdiction of the Courts and Tribunals of Benidorm (Spain).
